BMW Mini Cooper is Target of Potential Consumer Class Action Lawsuit By Tod Aronovitz | 03/20/13 | 0 Comment

A proposed class action lawsuit against BMW of North America, LLC, claims the auto company was not forthcoming about an alleged engine defect that causes some of its 2007–2009 Mini Coopers to stop running without warning.

Plaintiffs contend that BMW released a technical service bulletin addressing the defect in 2008, but did not issue a recall in order to avoid the cost of repairs. Some BMW owners reportedly paid thousands of dollars for needed engine repairs.

Complaints submitted by motorists to the National Highway Traffic Safety Administration, included in court filings, describe near crashes from complete engine failure as a result of the defect.

The proposed class action involves all people in the U.S. who currently or previously owned or leased the Mini Cooper Hardtop, model year 2007–2009, or the Mini Cooper Clubman with an N12 or N14 engine, model year 2008–2009, and who have paid to repair or replace any engine components as a result of a defect in the timing chain tensioner, according to the suit.

The case is Joshua Skeen, et al. v. BMW of North America LLC, Case No. 13-cv-01531, filed in U.S. District Court for the District of New Jersey.

The Mini Cooper dispute follows on the heels of another class action against BMW. The earlier suit, which focuses on faulty high-pressure fuel pumps and waste gates in an estimated 200,000 BMWs with twin turbos, has come to an unsuccessful settlement and is currently under review.
