Broward County Whistleblower Gets $1 Million in USA Parking Case By Tod Aronovitz | 12/19/12 | 0 Comment

James G. Wolk, an accountant who worked for USA Parking Associates in Broward County, will receive $1,008,000.00 as a whistleblower reward, according to a recent Sun Sentinel article. While working as the firm’s controller, Wolk uncovered an alleged scheme in which the parking company billed Broward County for insurance policy costs on multiple occasions when in fact the company was self-insured.

USA Parking Associates until recently held a long-term parking contract with the Fort Lauderdale-Hollywood International Airport, and continues to hold a parking contract at Port Everglades.

Whistleblowers and the Broward County False Claims Ordinance

The Broward County False Claims Ordinance is intended to deter persons from knowingly causing or assisting in causing the County to pay false, fraudulent, or inflated claims for products or services.

By acting as a whistleblower in what is known as a qui tam lawsuit under the Broward County False Claims Ordinance, the whistleblower may receive payments of between fifteen percent (15%) and twenty five percent (25%) of the proceeds recovered under any judgment obtained by the County or of the proceeds of any settlement of the False Claims action, with some exceptions.

Employees who are concerned about risking their jobs by initiating a whistleblower action should know that the Broward County False Claims Ordinance provides legal rights to any whistleblower employee who is “discharged, demoted, suspended, threatened, harassed, or in any other manner discriminated against” as a result of making a whistleblower claim.

Whistleblower cases typically receive special confidential treatment during the early investigation period, until allegations can be verified.
