Dr. Gary Kushner Sentenced to 12 Years in $50 Million Miami Medicare Fraud Scheme By Tod Aronovitz | 03/26/13 | 0 Comment

Dr. Gary Kushner, a former medical director for Biscayne Milieu Health Center, a Miami-based mental-health clinic, was recently sentenced to 144 months in prison for his role in a $50 million Miami Medicare fraud scheme, according to the U.S. Department of Justice and the Miami division of the FBI. He was also ordered to serve three years of supervised release.

Evidence uncovered in his two-month trial showed that Kushner and his co-conspirators paid patient recruiters to refer questionable Medicare patients to Biscayne Milieu. Kushner then knowingly approved treatment of patients ineligible for Partial Hospitalization Program (PHP) services and authorized millions of dollars in fraudulent billings to Medicare under his name. Kushner was convicted on August 28, 2012, of one count of conspiracy to commit health care fraud and one substantive count of health care fraud.

More than 25 employees of Biscayne Milieu have been charged with health care fraud and other offenses. The owners of Biscayne Milieu, Antonio and Jorge Macli, and its operator, Sandra Huarte, are scheduled for sentencing in April 2013.
