Home Health Care Agency Staffer Pleads Guilty in $7 Million Miami Fraud By Tod Aronovitz | 07/21/14 | 0 Comment

A former office worker who paid kickbacks and bribes to patient recruiters was connected to a $7 million health care fraud scheme in Miami, according to an announcement made by the U.S. Department of Justice.

Thirty-seven-year old Lizette Garcia pleaded guilty on one count of payment of health care kickbacks before U.S. District Judge Joan A. Lenard in the Southern District of Florida in June. She worked at Anna Nursing Services Corp., a now defunct home health care company that was based in Miami.

According to court documents, Anna Nursing operated solely to bill the Medicare Program for expensive physical therapy treatments and home health care services that were not medically necessary or actually provided.

On behalf of its owners and operators, Garcia paid kickbacks and bribes to patient recruiters in return for Medicare patient referrals to Anna Nursing. The agency then billed the Medicare program on behalf of the recruited patients, who were either given medically unnecessary treatment or did not receive treatment at all.

From October 2010 through April 2013, Medicare paid Anna Nursing approximately $7 million for these fraudulent claims.

Garcia, who knew Anna Nursing was in violation of federal criminal laws, will be sentenced on August 27.
