Merfi Clinic Owner Gets 9-Year Sentence for Miami Health Care Fraud By Tod Aronovitz | 03/20/14 | 0 Comment

Isabel Medina, the owner and operator of Miami medical clinic, Merfi Corp., was handed her punishment for participating in multiple Miami health care fraud schemes totaling more than $20 million, the Justice Department announced.

The 49-year old Miami resident was sentenced to serve 108 months in prison and three years of supervised release, and was ordered to pay $8,437,393 in restitution for her role in the Miami health care fraud schemes. Medina pleaded guilty before U.S. District Judge Ursula Ungaro of the Southern District of Florida on January 7.

Merfi Corp. was a medical clinic that employed physicians, physician assistants and other medical professionals who were authorized to write prescriptions for home health care services. According to court documents, Medina and her co-conspirators channeled those prescriptions and other pertinent medical documentation to area home health agencies and patient recruiters in return for kickbacks and bribes.

These home health care agencies, including Flores Home Health Care which we previously reported on our ARONOVITZ LAW Blog on August 20, actually operated for the sole purpose of billing the Medicare program for expensive physical therapy and home health care services that were not medically necessary or were not provided.

According to the Justice Department, Medina acknowledged that the  losses to the Medicare program exceeded $20 million as a result of her involvement in the Miami health care fraud schemes.

How to Report Miami Medicare Fraud

Healthcare or medical billing employees who have inside knowledge of questionable Medicare billing practices can file a confidential legal claim under the False Claims Act. By acting as a “whistleblower” in what is known as a “qui tam” lawsuit, a private party may collect between 10 to 30 percent of the amount recovered, depending on how the case is prosecuted.
