Miami Health Care Fraud: Nestor’s Owner Pleads Guilty to Kickbacks & Fraud in $6.5 Million Scheme By Tod Aronovitz | 07/11/14 | 0 Comment

Cruz Sonia Collado, the owner and operator of Nestor’s Health Services, Inc. (Nestor HH), entered a guilty plea for her role in a $6.5 million Miami health care fraud scheme.  The Miami-based company is no longer in operation.

The 64-year old from Homestead pleaded guilty before U.S. District Judge Robert N. Scola, Southern District of Florida, to one count of conspiracy to offer and pay health care kickbacks and to defraud the United States, and to one count of offering and paying health care kickbacks, according to an announcement by the U.S. Department of Justice.

Collado allegedly devised a scheme which involved her paying kickbacks to patient recruiters who brought Medicare beneficiaries to Nestor HH.  In turn, the home health care company billed Medicare for services supposedly provided to the patients who were recruited.

According to court documents, Collado and others operated Nestor HH for the sole purpose of billing Medicare. Bills were submitted for expensive physical therapy and home health care treatments that were either not medically necessary or ever provided.

From approximately March 2009 through at least January 2014, Nestor HH submitted more than $6.5 million in fraudulent claims for home health services. The company was reimbursed for more than $6.1 million before the scheme was uncovered.

As we reported on our ARONOVITZ LAW Blog on May 22, the case was part of an earlier crackdown in which more than 50 area residents had been charged for their alleged involvement in various schemes to defraud Medicare.
