Walgreen Claims for Glucosamine Arthritis Supplements Subject of Class Action Lawsuit By Tod Aronovitz | 11/15/13 | 0 Comment

Walgreen misled Florida consumers who purchased glucosamine and chondroitin supplements to restore lost or damaged cartilage, according to a new lawsuit filed in the U.S. District Court for the Southern District of Florida.

Boca Raton resident Marc Group is the lead plaintiff in the case, based on purchases of glucosamine arthritis supplements he made from a Walgreen store in Boca Raton during August 2012.

The supplements are popular with arthritis sufferers. As many as 27 million adults in the U.S. are estimated to be afflicted by osteoarthritis, the most common type of arthritis. Osteoarthritis, also called degenerative joint disease, occurs when cartilage in the joints breaks down.

Walgreen claims that glucosamine and chondroitin products “rebuild cartilage,” as promoted on the drug store’s website and product labels, are false and misleading according to the lawsuit. “It is medically impossible to rebuild cartilage that has been damaged or destroyed simply by taking glucosamine and/or chondroitin supplements,” claims the plaintiff.

Court filings cite several scientific studies that indicate both glucosamine and chondroitin are ineffective when used for the treatment of arthritis.

Violations of the Magnuson-Moss Warranty Act and the Florida Deceptive and Unfair Trade Practices Act are also alleged.

The case is Marc Group et. al. v. Walgreen Co., Case 9:13-cv-81105-KLR, filed in the U.S. District Court for the Southern District of Florida. Consumers who purchased the supplements between October 2006 and December 2012 may be eligible to participate.
